Nicholas Nardi practices in the areas of insurance coverage and environmental law. Nick has successfully represented insurance companies in complex environmental and construction defect insurance coverage matters throughout the Pacific Northwest. He has participated in developing key appellate law affecting insurers in Oregon and Washington.

Nick also advises clients in state and federal environmental compliance and litigation matters, including matters involving Clean Water Act and Superfund claims. In addition, Nick has significant experience in health insurance, ERISA, and government contracts law.

Nick is an avid backpacker and cross-country skier, and has spent much time in the backcountry of the Western United States and Canada. Nick also enjoys rock hounding with his wife, Elizabeth, in the deserts of the Pacific Northwest.

Representative Matters

Schnitzer Investment Corp. v. Certain Underwriters at Lloyd’s of London. Represented defendant insurers in action seeking damages for breach of contract, bad faith, and intentional misrepresentation in relation to claims for coverage for environmental contamination at sites adjacent to the Willamette River. Successfully represented the insurers on appeal of the case to the Oregon Supreme Court regarding the duty to indemnify.

Harbor Island Superfund Site, Lower Duwamish Superfund Site, and Port of Seattle Terminals. Represented insurer of the Port of Seattle in connection with substantial claims by the U.S. EPA and the Washington Department of Ecology relating to contamination at and near several Port properties, Elliott Bay, and the Lower Duwamish River.

Portland Harbor Superfund Site. Represented insurer of Schnitzer Investment Company and other related companies in connection with in-water contamination claims by the U.S. EPA, and soil and groundwater contamination claims by the Oregon DEQ relating to numerous upland sites.

Puget Sound Energy, Inc. v. Certain Underwriters at Lloyd’s of London. Represented insurer in insurance coverage action involving contaminated sites owned by regional electric utility in Northwest Washington.

Buckaroo Thermoseal, Inc. v. Valley Forge Ins. Co. Representing insurer in coverage action alleging breach of the duty to defend and indemnify in relation to lawsuits alleging defective construction in 10-building mixed-use development.
